Residential and Commercial Conveyancing
Our Property Team, based at our Littlehampton office, is headed up by Rob Fawcett, Solicitor/Managing Partner, who qualified in 2006, with Lisa May, MCILEX Conveyancing Executive, who has passed 16 exams since 2016 and has achieved the CILEX Level 6 Diploma in Law and Practice. We have 3 experienced Assistants, and a Property Consultant, Timothy Pitt. We also have a vast wealth of local knowledge and understanding.
Rob Fawcett deals with both residential and commercial transactions, and Lisa May deals with residential conveyancing.
It is widely known that moving home is one of the most stressful things that we have to deal with. With this in mind, our Property Team offer professional support and advice, and aim to provide a high quality and “hands on” approach in the hope that we can make the moving experience a much better one for everyone.
For those who looked to move home in 2023, it was especially challenging following the rise in interest rates and economy in general, which caused a downturn in the housing market. For 2024 it is hoped that there will be signs of improvement leading to a more buoyant housing market.
The commercial property market has remained busy despite the challenges mentioned, with businesses looking to move premises, purchase new premises, etc., which is very encouraging.
If you are thinking of moving or have a commercial property query, please contact Rob Fawcett or Lisa May, who will be very pleased to help you.

Relationship Agreements
Many couples who are considering living together, marriage or have recently married, enter the relationship with unequal assets. This could be for many reasons including being in the fortunate position to collate savings/assets, beneficiary of an inheritance or even one or both parties having a financial settlement following the breakdown of a marriage or separation.
Should one of these situations arise, the person bringing in the greater financial resource may wish to seek to protect such savings/assets if there should be a relationship breakdown in the future. This can be achieved by entering into one of the following:-
- Cohabitation Agreement – if you are intending to live together but not marry
- Pre-Marital Agreement – if you are intending to marry
- Post-Marital Agreement – if you are already married
In the event of a marriage breakdown, a Pre-Marital or Post-Marital Agreement is given high consideration by a Court in the event of a dispute as to how financial settlement should be achieved provided that it has been properly prepared and, in the event of a Pre-Marital Agreement within a reasonable time prior to the marriage.
Our Family Team is based at our Rustington office (2A Broadmark Parade, Rustington, West Sussex, BN16 2NE) with Sharon Lyon (Partner and Head of Department), Tracy Randall-May (Solicitor), and Tracy Hammond-Smith (Assistant). “I just wanted to say a big thank you to the Partners here at E J Moyle LLP for supporting me during my training to become a CILEX Law Graduate and to all members of our Firm for cheering me on throughout the highs and lows of the last 7 years.
I started the CILEX programme back in 2016 and sixteen gruelling exams later, I have at long last completed the academic programme to become a CILEX Law Graduate.
So much has happened during that time, not just to me but to all of us, and I really do feel that I have had the support of an amazing work family who I couldn’t have done it without”.

Grant of Probate

During the Covid-19 pandemic major changes were made to the process for applying for Grants of Probate. In most cases, a Grant of Probate is required to deal with an Estate where the assets exceed £10,000. This application is made by the Executors to allow them control of the assets, pay any liabilities and distribute the Estate.
In November 2020, the Courts Services introduced an online application process for most Estates, where the deceased had a Will - with several exceptions to online applications. If the exception applies, a paper application is needed.
Online applications were introduced for professional and non-professional applicants and coincided with the closure of local Probate Registries, increases in application fees, digitalised services and changes in legislation for Inheritance Tax. These changes signaled the most significant shift in the process for applying for Probate in the last 50 years.
The online system intended to make the application for a Grant of Probate more accessible to non-professionals can instead result in more complex issues regarding tax, tax exemptions and Trusts to be missed by non-professional Executors. This can cause problems for Estate Beneficiaries and Executors. An Executor is personally liable for an Estate.
If you have begun dealing with an Estate, but found the process overwhelming, or you have been notified that a paper application is required, or you cannot locate the Will - then our Team can assist you. We can address the areas which need your attention and finalise the application for Probate, conclude the Estate Administration, stress free. If you need assistance or wish to discuss the best way forward, please contact me on 01903-784447 or email scarelessshore@moyle.co.uk

Closure of Litigation Department

Over the last year, the Partners, Rob Fawcett, Managing Partner, Sharon Lyon, Risk and Compliance Partner, and Sophie Careless-Shore, Head of Private Client, have put in place a strategic plan for E J Moyle LLP which aims to promote and develop a niche law firm, offering niche legal services to clients and businesses across Rustington, Littlehampton, Worthing and the Sussex area.
With this is mind, the Partners have decided to close their Litigation Department from the end of February, 2023, and so will no longer be able to offer this service. This was a very difficult decision to make, and one which took a long time to arrive at, but it will now allow us to promote our niche services, with a Partner heading up each Department:
Rob Fawcett, Solicitor and Managing Partner, and Head of Residential and Commercial Property, offering legal services in relation to residential property and commercial property transactions of all types.
Sharon Lyon, Solicitor and Risk and Compliance Partner, and Head of Family Law, offering legal services in relation to Children matters, divorce, financial settlements, and pre-nuptial agreements)
Sophie Careless-Shore, Solicitor and Head of Private Client, offering legal services in relation to Wills, Probates, LPA’s, EPA’s and Trusts).
By offering legal services in these 3 niche areas, we aim to consolidate our already excellent local reputation, and continue to offer the high quality service that we have provided over many years.
The Partners look forward to welcoming past and existing clients back, and to working with new clients and businesses in the future.
Rob, Sharon or Sophie all look forward to hearing from you.
