Bart completed his Bachelor’s Degree in Law along with his CILEX Fast Track Diploma in 2020, and a Master’s Degree in Law and LegalTech in 2022, and is now looking to complete the practical stage of his CILEX qualifications on his route to qualifying as a Chartered Legal Executive.

Preparing a Lasting Power of Attorney

Have you considered what would happen to you if you were unable to manage your property, finances or health?

By preparing a Lasting Power of Attorney you can protect yourself and those you love from financial difficulty or decisions surrounding care.

Lasting Powers of Attorney were introduced in 2007 to replace Enduring Powers of Attorney, whilst including several steps to protect the person making the Power.  If you have an Enduring Power of Attorney this remains valid but can only be registered at  Court to be used by the Attorneys if the person making the Power is not able to make their own decisions.  This can cause difficulties for the Attorneys as the current timeframe for registration at Court is approx. 6 months. If you lose capacity and have a Lasting Power of Attorney this can be registered at Court immediately and can be used by the Attorneys without delay.  Whilst we hope you never need to rely on a Power of Attorney, by having one in place, this removes any worries for the future if you lose ability to make decisions yourself. 

A Lasting Power of Attorney will allow you to name friends, family or a Solicitor to help you by making those decisions on your behalf. This process can be undertaken by both legal and non-legal applicants online or directly through the Court.  If you have begun this process but become overwhelmed, unable to complete it, require and understanding of what is involved, or details about the 2 types of Lasting Powers (Property/Financial and Health/Welfare), we can assist. Our Private Client Team can help prepare and register Powers at the Office of the Public Guardian.

Our Property Team, based at our Littlehampton office, is headed up by Rob Fawcett, Solicitor/Managing Partner, who qualified in 2006, with Lisa May, MCILEX Conveyancing Executive, who has passed 16 exams since 2016 and has achieved the CILEX Level 6 Diploma in Law and Practice. We have 3 experienced Assistants, and a Property Consultant, Timothy Pitt.  We also have a vast wealth of local knowledge and understanding.

Rob Fawcett deals with both residential and commercial transactions, and Lisa May deals with residential conveyancing. 

It is widely known that moving home is one of the most stressful things that we have to deal with.  With this in mind, our Property Team offer professional support and advice, and aim to provide a high quality and “hands on” approach in the hope that we can make the moving experience a much better one for everyone. 

For those who looked to move home in 2023, it was especially challenging following the rise in interest rates and economy in general, which caused a downturn in the housing market. For 2024 it is hoped that there will be signs of improvement leading to a more buoyant housing market.

The commercial property market has remained busy despite the challenges mentioned, with  businesses looking to move premises, purchase new premises, etc., which is very encouraging.

Christmas Jumper Day at E J Moyle LLP, Solicitors

It’s nearly that time of year when thoughts turn to the festive season, and spending time with our loved ones

Looking back on 2023, it has had its challenges including the cost of living crisis, high interest rates, and the unstable economy in the UK, all of which have had an impact on individuals and businesses alike.   For our part, we are proud that we have been able to continue to develop and grow our Firm so that we are able to help clients with their legal issues from residential and commercial conveyancing transactions, Probate, Wills and Powers of Attorney matters, and family issues, including child care, divorce and contact.

E J Moyle LLP has also continued to support local charities during 2023, and we will continue to do so in 2024.

You may know that it’s National Christmas Jumper Day on 7th December, and we will be supporting this by wearing our festive jumpers to work on this day and baking cakes to raise funds for our chosen charities, Whizz Kidz and SCOPE.  We will also be donating items to the  Turning Tides Charity this Christmas.

Relationship Agreements

Many couples who are considering living together, marriage or have recently married, enter the relationship with unequal assets.  This could be for many reasons including being in the fortunate position to collate savings/assets, beneficiary of an inheritance or even one or both parties having a financial settlement following the breakdown of a marriage or separation.

Should one of these situations arise, the person bringing in the greater financial resource may wish to seek to protect such savings/assets if there should be a relationship breakdown in the future.  This can be achieved by entering into one of the following:-

  1. Cohabitation Agreement – if you are intending to live together but not marry
  2. Pre-Marital Agreement – if you are intending to marry
  3. Post-Marital Agreement – if you are already married

In the event of a marriage breakdown, a Pre-Marital or Post-Marital Agreement is given high consideration by a Court in the event of a dispute as to how financial settlement should be achieved provided that it has been properly prepared and, in the event of a Pre-Marital Agreement within a reasonable time prior to the marriage.

Grant of Probate

During the Covid-19 pandemic major changes were made to the process for applying for Grants of Probate.  In most cases, a Grant of Probate is required to deal with an Estate where the assets exceed £10,000.  This application is made by the Executors to allow them control of the assets, pay any liabilities and distribute the Estate. 

In November 2020, the Courts Services introduced an online application process for most Estates, where the deceased had a Will - with several exceptions to online applications.  If the exception applies, a paper application is needed.

Online applications were introduced for professional and non-professional applicants and coincided with the closure of local Probate Registries, increases in application fees, digitalised services and changes in legislation for Inheritance Tax. These changes signaled the most significant shift in the process for applying for Probate in the last 50 years.

The online system intended to make the application for a Grant of Probate more accessible to non-professionals can instead result in more complex issues regarding tax, tax exemptions and Trusts to be missed by non-professional Executors.  This can cause problems for Estate Beneficiaries and Executors.  An Executor is personally liable for an Estate.

We can address the areas which need your attention and finalise the application for Probate, conclude the Estate Administration, stress free.
